Don't know for definite - but pretty sure its a violation of the Wildlife + Countryside Act for starters. "Causing unnecessary suffering etc"

Very little in that article about the badger and the circumstances and legalities, it's more a general bash....

As far as I'm aware you cannot snare badgers, you can't hunt them at all without special permission such as the cull. However, sometimes other things get caught in legally laid snares that re intended to other animals, it's one of the reasons that snares should be sited correctly (well away from badgers) as well as sized correctly etc...
There's no info in this article that says if it's a sad accident or a criminal act, saying that there's plenty of people that will not care either way and just rant about it.
