I have a few knives, some made by me and some by others, and I'd like to sell some of them. Are their any legalities related to this? Like is it under 16's or under 18's that can't buy knifes? This is scotland I'm talking about BTW. Is it fine over the internet, do I need to get proof of age etc? Don't want to get involved with the police again.
Cheers

Google brings up a lot of references about Scotland introducing a licensing scheme for people selling "non domestic" knifes in Scotland.

This would be part of a "Custodial Sentences and Weapons Bill" and although there are references to this dated 2007, I can't actually see where the bill has got to.

However, unless someone here can confidently provide a definitive legal response (on the law in Scotland) I would take the time to try and follow this up.

Now there's an interesting legal question....If you are under 18, you can't buy knives... but can you sell them ?? - obviously you won't be able to buy in stock to sell on, but i'm not aware of a lower age limit for making knives... hmmmmm...:22:

I asked on BB and the advice given is that over 18 to buy and sell resticted items.
The actual quote was,
"Sellers of age restricted items have to be above the age set as well as buyers - hence the checkout kid getting the supervisor over when you buy booze etc."

The latest relevant piece of legislation is contained in
http://www.opsi.gov.uk/acts/acts2006/en/ukpgaen_20060038_en_1

cheers,
Toddy

Were BB able to give the current status of the Bill I mentioned earlier, as that seems to be the important bit, given the seller is in Scotland, and that the Act you cite is not enacted identically across the UK.

I haven't been able to find anything that useful by Googling.

I am 18, but a few months ago it said something like 27 for some reason. It's all over the place. But, I remember when I was 17, going into shops, and being asked my age, saying 17 and being sold every time? So, is it 16 or 18?

As of March 2008, the act had not yet been implemented but received Royal Assent on 19th April 2007

I can foresee problems and possibly more in the future regarding legislation such as this if enacted by the Scottish Parliament.
Will this apply only to Scott's, can Scott's visiting England buy legally and take back to Scotland.
Can knives be purchased by mail order or over the web complying with the sellers local laws in the UK be sent to Scotland.
Will this apply to visitors to Scotland.
What reasonable checks can a seller be expected to make before selling such an item, what forms of ID are acceptable.

The whole things is going to be another Dangerous Dogs Act.

From what I read its the seller, if based in Scotland, who will need to be licensed before they can sell knifes.

So apart from a bit more paperwork, and presumably the ability to take someone license away if they have committed some sort of an offence, will it make much difference to the day to day selling and buying of knives ?
