lighting fires

quick question for people in the know.

should i wish to go out without a stove/cooker, where would i
stand on digging a shallow pit and lighting a fire to cook/ get warmed up with?

The trouble is finding a bit of land where you can get the landowners permission with out that you could be done for criminal damage
