The ones that I've seen are yes, any that become used it's because they're no longer suitable for their role. new ones no longer have creosote on them but it'll be many years before they need to be replaced so until them I'm stuck with a market flooded with older generation ones.

hot and cold are used to treat different injuries, not to be mixed up. I dont recall it though. I have a physiotherapist friend I'll ask her in the morning and post which way round it is. She always shouts at me for using heat when i should be using cold :(

also give ralgex a try, i find it works better than deep heat but its most likely the same kind of stuff.
